Custom Paper: The US is a Federal Constitutional Republic
The US is a Federal Constitutional Republic
Since its inception following the United States Declaration of Independence, the US remains a federal constitutional republic in which the state governments share sovereignty with the federal government. While drafting America’s constitutional dispensation, Thomas Jefferson along with other founding fathers was very suspicious of a strong central government.
They were worried that centralization of power would lead to authoritarian rule as witnessed in Europe at the time. They wanted to create a balance of power by establishing state governments charged with making laws on all matters not limited to the state and (or) not granted to the federal government. The state governments exercised this mandate by enacting the family law, criminal law, contract law and education laws. Since the state governments enjoyed inherent powers, exercising these powers infringed on individuals’ freedom and civil liberties.
